What you need to know
TWO SEPARATE APPROVAL TYPES: (1) PRIVATE LAND (food trucks cooking on-site): Notification of Food Truck Selling Food on Private Land form, submitted annually at start of financial year. Must attach Plan of Management. EHO vehicle inspection arranged after application. Vehicles from outside LGA need satisfactory inspection report within 12 months. Home kitchen requires Occupation/Compliance Certificate from Council. Apply at penrithcity.nsw.gov.au/services/health-safety/mobile-food-vending-on-private-land. (2) ROADSIDE/PUBLIC LAND (pre-packaged, coffee, ice cream): Mobile Food Vending Vehicles Registration Form, submitted annually. Annual EHO roadside inspection required before approval issued. Vendors must remain mobile; cannot stop more than 15 minutes without serving; must move minimum 500 metres before stopping again. Apply at penrithcity.nsw.gov.au/services/health-safety/mobile-food-vehicles-trading-roadside. Both require Food Safety Supervisor for high-risk food. FEE STRUCTURE (2026-27, confirmed from the adopted Penrith City Council 2026-2027 Fees and Charges PDF — ENVIRONMENTAL HEALTH section, all GST-free): MOBILE FOOD VENDORS (Local Government Act): Application for Approval to Operate (includes 1 inspection): $270 (up from $260). Renewal of Approval to Operate (includes 1 inspection): $270 (up from $260). Application for Approval to Operate on Council Land (includes 1 inspection): $382 (up from $368). Renewal of Approval to Operate on Council Land (no inspection): $69 (up from $67). Inspection/Reinspection Fee: $201 per inspection (up from $194). ANNUAL ADMINISTRATION CHARGE (Clause 15, Food Regulation 2015): 5 or fewer FTE food handlers $384 (up from $370); 6-50 FTE $754; 51+ FTE $2,376. Confirm with Council whether this Clause 15 charge applies to your vehicle in addition to the MFV approval fee. FOOD PREMISES INSPECTIONS (Clause 14): Category 2 Food Business General (restaurants, takeaways, cafes, caterers) $208; Category 3 Small and Low Risk $158. Re-inspection for minor non-compliance $158/hr. TEMPORARY FOOD PREMISES: pre-packaged/non-hazardous inspection $61 per outlet; food handling / potentially hazardous food inspection $93 per outlet. NEW IN 2026-27: Annual Approval to sell food from a temporary food stall or food van (EXCLUDING mobile food), including one primary inspection: $190 — this fee did not exist in 2025-26.
